TERMS AND CONDITIONS FOR SENDERS/USERS
These General Terms and Conditions set out below applies and govern the usage of the Drop it off website and app which helps connects users(sender or receiver) with drivers to help them delivery their product, goods or any other movables around their cities more efficiently.
The term “us” or “we” refers to the owner of the Drop it off app, Drop it off delivery, a private limited company, founded in the Republic of South Africa (Company Registration Number K2019072201), In order to use Drop it off user app you must agree to the terms and conditions that are set out below:
(1) USING THE DROP IT OFF APP
(1.1) Drop it off provides an information society service through Drop it off app that enables mediation of the requests for delivery services between the senders of a parcel and drivers, and Drop it off does not render delivery services. Delivery services are provided by drivers under a agreement (with you) for the delivery of your product. Drivers render delivery services on an independent basis (either solely in person or via a company) as professional service providers. Drop it off is not responsible in any way for the fulfilment of the agreement entered into between the sender (you) and the driver. Disputes arising from consumer rights, legal obligations or from law applicable to the provision of delivery services will be resolved between the senders/users and drivers. Data regarding the drivers and their delivery service is available in the Drop it off app and receipts for deliveries are sent to the email address listed in sender’s profile.
(1.2) The sender (you) acknowledges that he/she enters into an agreement with the driver for the provision of delivery services via the Drop it off app. Depending on the payment options supported on the drop it off app, you can choose if you want to pay the driver for the delivery service in cash or use Drop it off in-App Payment. Charges will be inclusive of applicable taxes where required by law. Charges may include other applicable fees, and/or surcharges including a booking fee when necessary, municipal tolls, and or processing fees.
(1.3) Upon the installation of Drop it off app, sender’s/user’s mobile number is linked to their respective Drop it off user account and added to our back-end database. If you no longer wish to use your mobile number currently registered on your account, you must notify Drop it off within 7 days so we can update your account details to the current details. If you do not notify us about any change to your mobile number, your mobile operator may issue the same mobile number to a new person, Drop it off will not be liable for any or such person having access to your account details
(1.4) The sender of a parcel/package is responsible for packaging the parcel/package before giving it to the driver to deliver to their desired destination, Drop it Of and its affiliates takes no responsibility for any parcel/package that is not properly packaged for transportation.
(1.5) Drop it Off take no responsibility for any missing package/parcel that is not delivered on time, missing or damages. Drop it Off within reasonable effort with help I the location of the driver, assist the relevant authorities in the retrieval of your parcel/package.
(2) COUPON CODES
(2.1) Drop it off may send you coupon codes on a per promotion basis. coupon code can be applied towards payment on start of a delivery or other features that may be related to the service and/or a Third Party’s service and may be subject any additional terms that are established on a per promotional code basis. Dates if Expiration of promo codes will be reflected in-app and will not be available once used or expired.
(2.2) If your delivery fare amount exceeds the redeemable credit allocated to your delivery, the balance will be deducted from your Drop it Off accounts payment method. A Coupon code only applies to one delivery per user cannot carry over to a next delivery order and. Only one coupon code may be applied per delivery.
(2.3) Drop it off reserves the right to cancel any coupon code at any time for any reason. This includes, but is not limited to, if Drop it off deems that codes are being used in a fraudulent or an unlawful manner, an coupon issued mistakenly, and any expired coupon.
(3) DROP IT OFF iN-APP PAYMENT SYSTEM
(3.1) In-App Payment options supported for delivery is “Debit/Credit Card”, you can pay for the delivery services with your supported card when available through Drop it off App. Drop it off acts as commercial agent for the providers of the delivery services (e.g. Drivers). Each and every driver on the Drop it Off platform has authorized Drop it off to receive payment for the delivery of any parcel/package sent by the sender/user, including the right forward the payments to the driver after payment has been collected. Your responsibility to the provider of the delivery service (“e.g. Driver”) will be completed when the payment authorization is given to transfer funds to Drop it off’ bank account. The sender of a parcel/package is responsible for making sure that the payment takes place and ensuring that sufficient funds are available in their designated account.
(3.2) When using the in-App Payment system, Drop it off receives your payments and forwards money to the driver. Drop it off may ask additional information from you to verify payment is valid at any point in time, please note that we do not keep any of your card details on our database, so your details are securely safe with you.
(3.3) Also when using the in-App Payment system as the preferred payment option for the payment of the delivery services, Drop it off takes no responsibility for any possible third-party costs incurred (e.g. mobile operators, bank fees, etc). Drop it off deny all liability in this regard. Your payment method selected when using the Drop it Off app may be subject to additional terms of use imposed by the relevant third-party payment service provider, it is advisable to review all terms of use before selecting your payment method.
(3.4) Drop it off will be responsible for the functioning of Drop it off in-App Payment and provide any support in resolving problems that may arise, however Drop it Off in-App payment system is provided by a third party and Drop it Off takes no responsibility of the malfunction that may occur from the third party but will do its best to resolve any dispute that may arise in such cases and the resolution of disputes related to Drop it off in-App Payment also takes place through us. For support relating to payment service please contact: payments@dropitoffglobal.com. Any inquiries submitted by e-mail or via the Drop it off in-App chat will receive a response within one business day. Drop it off will resolve any in-App Payment related issues within three business days.
(4) ORDER AND CANCELLATION OF DELIVERY
(4.1) Any delivery service ordered and the driver has agreed to undertake the delivery, is such acceptance the delivery service is deemed to be ordered.
(4.2) upon confirmation from a driver that he/she will delivery your parcel/package, you will enter into a separate understanding with the designated driver for the provision of the delivery on such terms both you and the driver are in agreement. Drop it off is not a provider of delivery services and is not a party to your agreement with the relevant driver.
(4.3) The cancellation of an ordered delivery service is deemed to be the situation where the driver has replied to your request and you continuously reject, cancel or refuse the delivery service. When the service request is cancelled after driver has accepted and is on route to collect the parcel you are required to pay a cancellation fee.
(4.4) If you continuously cancel a delivery request on multiple occasions within a 24-hour period Drop it Off may temporarily block your account for warning without any prior notice. After multiple continuously cancellation warnings, Drop it Off may suspend your account for longer period in its own discretion (e.g. 3 months or more). After which you could ask to reactivate your account.
(4.5) If driver has notified the sender about his/her arrival to the desired delivery point and sender or people for whom the delivery was ordered do not arrive with a reasonable time, the delivery request will be deemed cancelled and no refund will be issued to the user/sender or its people in this case. When a driver decide to cancel your request, please note that Drop it off is not responsible for any issues that may arise.
(5) AUTHORIZATION TO THE DROP IT OFF APP
(5.1) It is imperative that all sender/user comply with these General Terms and Conditions, we agree to grant you a revocable, non-exclusive right to access and use the Drop it off app in line with with these Terms and Conditions, the Privacy Policy and all related terms. You may not transfer or sub-license this right to use the Drop it off app. In a situation where your right to use Drop it off app is revoked, the license will also be revoked.
(6) LIABILITY
(6.1) Giving that the Drop it off app is an information society service (a means of communication and connection) between senders/users and drivers, Drop it off does not guarantee or take any responsibility for the quality or the absence of defects in the provision of delivery services. As the usage of the Drop it off app for requesting delivery services will depends on the conduct of the drivers, Drop it off does not guarantee that there will always be offers available for the provision of the delivery services.
(6.2) The Drop it off app does not offer or mediate delivery services for senders. Drop it off is also not a delivery agency of any kind. Drop it off app is used as the medium for arranging the provision of delivery services.
(6.3) The consumer’s right of refund is not applied to Drop it off app delivery orders. Requesting a refund from the delivery service ordered does not remove you from the agreement in the course of which the provision of the delivery service was ordered.
(6.4) The Drop it off does not represent, warrant or guarantee that access to Drop it off app will be uninterrupted or error free .Drop it off app is provided on an “as is” and “as available” basis.. In any issues arises in the software, Drop it Off will do its best to correct them as soon as possible, furthermore the functioning of the app may be restricted due to subsequent technical errors and we do not guarantee that the app will function at all times.
(6.5) Drop it off, its representatives, directors and employees are not liable for any loss or damage that you may incur as a result of using Drop it off app or relying on its usage, the service contracted through the Drop it off app, including but not limited to:
(6.5.1.) all or any direct or indirect property damage or monetary loss;
(6.5.2). all or any loss of profit;
(6.5.3.) all or any loss of business, contracts, contacts, goodwill, reputation and any loss that may arise from the interruption of the business or your business or that or any related party;
(6.5.4.) all or any loss or incorrect data; and
(6.5.5.) all or any other type of loss and or damage.
(6.6) Drop it off takes no responsibility for any actions or inactions of the driver and will not be liable for all or any form damages that the driver causes to the senders or receivers package/parcel.
(6.7) By using the Drop It Off App you agree to fully indemnify and hold Drop it off, their affiliate companies, representatives, employees and directors harmless from any claims or losses (including liabilities, damages, costs and expenses of any nature) that you may suffer as a result of your use of the Drop it off app (including the services you obtain through your use of the Drop it off app).
(6.8) Drop it off may immediately/completely/entirely end your use of the Drop it off app if you breach these General Terms and Conditions or we consider it necessary to protect the integrity and image of Drop it off or the safety of drivers on its platform.
(7) BEST PRACTICE
(7.1) Giving the face that Drop it off is not a provider of the delivery services, any issues with defects or quality of the delivery services will be resolved in accordance with the rules and regulations of the delivery service provider or the relevant public authority.
(7.2) Senders/users are asked to fill out a feedback form in the Drop it off app from time to time. This enables Drop it off to offer suggestions to the for the improvement and the quality of the service provided by the drivers.(7.3) Drop it off expect that you use Drop it off app in good faith and be polite to the drivers who offer their delivery services through Drop it off app. Drop it off reserves the right to terminate your account if you have violated any of the terms set out in this General Terms and Conditions or if your activities are malicious/hostile, i.e. fraud, disrespecting drivers, etc. In these cases, your Drop it off app account may be terminated without prior notice.
(7.4) Drop it off will take effort to ensure that drivers on the platform have been verted the best possible way, and are honest and respectful of their profession and senders/users. However, we do not guarantee that every provider of delivery services using the Drop It Off app, satisfies the criteria at all times. If you experience unpleasant service, please notify the company responsible for the service, or a supervisory authority or Drop It Off customer support.
(8) AMENDMENTS TO TERMS AND CONDITIONS
(8.1) If any substantial amendments are made to the General Terms and Conditions, then you will be notified by e-mail or via the Drop it off app. Your continuous usage of the Drop it off app will be deemed as acceptance of the amendments.
(9) FINAL PROVISIONS
The General Terms and Conditions will be governed by and construed and enforced in accordance with the laws of Republic of South Africa. If a dispute resulting from the General Terms or Agreement could not be settled by the negotiations and mediations, then the dispute will be referred to the High Court of the Republic of South Africa (Gauteng Division).
If any parts or provision of these Terms is held to be unenforceable, the parties will substitute for the affected provision an enforceable provision that is equal to the intent of the affected provision.
